These Terms of Service govern your use of services provided by SMPL Strategies, a division of TZG LLC. By submitting an intake form or making a deposit payment, you agree to these terms.
SMPL Strategies provides website design and development services for local businesses. Services are scoped to the tier selected at the time of intake. No features outside the selected tier are included unless agreed to in writing before the deposit is collected.
Available tiers and their included features:
Delivery windows begin when the deposit clears and the completed intake form is received. Delivery windows are business days and do not include weekends or federal holidays. Delays caused by incomplete or late submission of required content (copy, images, contact information) may extend the delivery window without affecting the deposit or fee.
A non-refundable deposit is required to begin the build. The deposit amount is 20% of the selected tier price. The remaining balance is due upon delivery and must be paid before the completed site is transferred or made live.

The deposit is non-refundable in all circumstances. If you cancel after the deposit is paid but before delivery, no additional charges will be assessed beyond the deposit amount already collected.
If SMPL Strategies is unable to deliver the agreed scope within the delivery window for reasons within our control, you may request a full refund including the deposit.
One round of revisions is included with every tier. Revisions must be submitted within 7 business days of delivery. Revision requests must be within the scope of the selected tier. Feature additions or scope changes outside the tier are quoted separately.
You are responsible for providing all written copy, images, and business information required for your site. SMPL Strategies may use placeholder content during the build if your materials have not been submitted. Final delivery requires your approved content to be in place.
By submitting content to SMPL Strategies, you confirm that you own or have the right to use all submitted materials and that their use does not infringe on any third-party rights.
Upon receipt of the final payment, ownership of the completed website design and all original assets created for your project transfers to you. SMPL Strategies retains no ownership claim over delivered work.
SMPL Strategies may display completed work in a portfolio or as a demo example unless you request otherwise in writing at the time of intake.
SMPL Strategies is not liable for indirect, incidental, or consequential damages arising from your use of the delivered website, including but not limited to lost revenue, lost leads, or downtime caused by your hosting provider.
Our total liability to you for any claim arising under these terms is limited to the total amount you have paid to SMPL Strategies for the project in question.
SMPL Strategies works with independent sales representatives on a commission basis. Representatives are not employees of SMPL Strategies or TZG LLC. Representatives are not authorized to modify pricing, expand scope beyond a selected tier, or make promises on behalf of SMPL Strategies that are not reflected in these terms. Any representation made by a sales representative that is inconsistent with these terms is not binding on SMPL Strategies.
